Introduction
This Privacy Policy establishes the norms and practices regarding data protection within the virtual site “Infraestructura en América Latina y El Caribe: Datos de inversión en infraestructura económica.” (the “Virtual Site”), a site whose creation aims to disseminate results obtained from investments measurement in Latin American and Caribbean countries (“LAC”). The Virtual Site is created, administered and funded by the Inter-American Development Bank (“IDB”), the Development Bank of Latin America (“CAF”) and the United Nations Economic Commission for Latin America and the Caribbean (“ECLAC”) (jointly referred to as “The Administrators” and as “we”, “our”, “ours” or similar pronouns).
As it is laid out in the Terms and Conditions, document of which this Privacy Policy is an integral component, the IDB is an international, public organization, created by its members under the “Agreement Establishing the Inter-American Development Bank”, whose objective is to promote economic and social development throughout LAC. The CAF is a development bank established in 1970, comprising 19 countries – 17 from Latin America and the Caribbean plus Spain and Portugal – and 14 private banks, also from the region. It promotes a sustainable development model through credit transactions, grants and support for technical and financial project structuring for public and private sectors in Latin America. The ECLAC was established in 1948 as one of United Nations’ five regional commissions. Its goals are contributing to Latin America and the Caribbean’s economic and social development, coordinating actions aimed at its promotion, and strengthening economic relations between the region’s countries and between them and the rest of the world. From its beginning, infrastructure services have been key aspects of ECLAC’s contribution to the region. ECLAC’s main mission in this area is fostering sustainable management and provision of infrastructure services in Latin American and Caribbean countries, in order to promote increased productivity and competitiveness as ideal means for achieving economic and social development.
For more information about The Administrators and the Virtual Site, as well as about their operation, please carefully read the Terms and Conditions of the Virtual Site. Some elements or functions on the Virtual Site may, now or in the future, require for you to identify yourself as a user as well as agree to terms and conditions, different or additional to the existing ones, which may also include different privacy policies.
Please read this Privacy Policy in its entirety before using the Virtual Site. For the purposes of using this Virtual Site you accept the terms and conditions of this Privacy Policy, as well as any further modification they may suffer. By using this Virtual Site you consent for us to collect, use and disclose your personal information as obtained through the Virtual Site, according to what is described in this Privacy Policy.

The PII will be collected when provided by you, for instance, through the sending of an electronic message or when publishing information in shared areas of the Virtual Site. Should there be elements such as blogs, which allow for the publishing of comments or other materials of similar nature to be reasonably exhibited on the Virtual Site and which directly or indirectly include PII, and if such elements are not subject to other terms and conditions and/or privacy policies, you recognize and accept that any PII you include in said comments or material may be publicly accessible and that we cannot control how other users might use such PII.
Automatically Gathered Information
When you visit the Virtual Site, certain anonymous information related to your visit is automatically gathered. Web Servers gather anonymous records during the users’ visits to the Virtual Site, through cookies, 1 pixel by 1 pixel GIF images (or clear GIF) or similar technologies, in order to store data about you and your use of this Virtual Site.

Use of Information Gathered Through the Virtual Site
There is a possibility we will use gathered PII about you (as described above) to send you electronic messages, messages through regular postal service or through other ways of communication in order to establish contact with you, so as to respond to enquiries made by you. In the same manner, it is possible we will use PII data to send you information that may be of your interest, such as new projects’ descriptions, Administrators’ activities, etc. There is also the possibility of us using PII for the purpose of keeping records among The Administrators, as well as combining PII gathered about you with other data – PII and not PII – obtained from other sources, for instance from other users, in order to carry out analyses relevant to the Virtual Site and to The Administrators’ common goals.
Given the case you request to receive news via e-mail, we will periodically send messages, promotional or otherwise containing information related to the use of the Virtual Site and/or The Administrators. Upon receiving a message from us, you will be able to let us know you would rather “opt out” of our mailing lists and thus shall stop receiving messages from us. To that effect you must either follow given instructions in order to unsubscribe – provided within the message – or send an “opt out request” to the contact e-mail address provided below, as appropriate.
We use the gathered anonymous information to analyze the Virtual Site’s visitors’ behavior, as a measure of how much interest the Virtual Site generates. With that as starting point, aggregated statistics are generated about, for instance, when the Virtual Site registers access, which web pages referred visitors to the Virtual Site and the type of browser said visitors use. These statistics allow us to comprehend how the Virtual Site is being used and at the same time they comprise a valuable information corpus which will allow us to improve the Virtual Site in the future.
Disclosure of Information Gathered Through the Virtual Site
Disclosure as Required and Permitted by Law
We may disclose PII or other data gathered through the Virtual Site in response to legal proceedings or when we, in good faith, consider it is required by law, for instance, in response to an order issued by a court, a citation or a request by a police authority. It is also possible for us to disclose said information in order to protect the normal operation and safety of the Virtual Site and/ or the rights of other users, as well as to protect ourselves and our partners, affiliates, advisors and providers against all liability or if we are led to believe someone may be causing or threatening to cause harm or interference against the rights or property of The Administrators. We may also disclose information as a means of protection against fraud.
Commercial Transactions
In case part of the assets or operations belonging to the Administrators is to be, individually and separately, sold or handed over; fused or otherwise transferred to another party, it is possible we will transfer your PII as part of the transaction. In the event such transfer takes place, The Administrators will do every reasonable effort in order to guarantee your IPP will remain covered by the same type of protection it was afforded prior to said transfer. Nevertheless, once your IPP is transferred in this manner, it will no longer be subject to this Privacy Policy and thus you ought to consult the practices and policies of whomever receives the information in order to become aware of the protection that shall be granted to your PII in the future.
Personal Information Updates
In the event you have not provided us with IPP, whether through the Virtual Site’s contact email address or by including information in blogs or similar elements, you may still request for us to correct or delete it. For the purpose of protecting you, we will only follow up requests done on behalf of PII associated to the e-mail address used by you to send the request, and it is possible we will have to verify your identity prior to any transaction.
Every effort will be made to respond to all requests, even those regarding the elimination of PII from our records, within a reasonable period of time. Some information we will have to keep in our records along with residual information which will not be eliminated and thus will remain in our databases and other records.
Please bear in mind we are not responsible for correcting, updating or eliminating any PII information on the Virtual Site. We cannot control the use or retransmission of any PII already obtained by any visitor of the Virtual Site.
Data Security
We make every effort to maintain the security and integrity of the PII we collect, through physical, electronic and management procedures in order to preserve and shield information against loss, inappropriate use, unauthorized access or disclosure, alteration or destruction. However, given the inherent nature of the Internet as an open, global communications vehicle, we cannot guarantee any datum – whether during its transmission through the Internet or while stored in our data systems or in any other manner kept by us – to be absolutely safe against a third party intrusion, including information provided by us via electronic message, through direct posts on the Virtual Site, or through the Contact e-mail. When providing information through these channels, you must bear in mind it is possible for the transmission not to be safe during transit and therefore a third party may see the information while in transit.
Data Retention
PII information as well as anonymous information gathered through the Virtual Site is retained for legal, recording and operative purposes. We shall retain PII information about you for as long as needed in order to achieve the goals already mentioned in this Privacy Policy or in our retention policies.
International Data Transfers
Information (even PII) sent through the Virtual Site will be processed in the United States of America (U.S.). It is possible that current U.S. legislation regarding data protection and other types of privacy does not offer the same level of protection as legislation in other countries. In providing personal information to The Administrators from outside the U.S. – whether directly or indirectly – through the Virtual Site or otherwise, you expressly consent to transfer said information to the U.S., in conformity with the protection measures described in this Privacy Policy.
Privacy of Information Pertaining to and about Minors
The Virtual Site is not targeted at minors and we neither intentionally gather personal information about minors under the age of 13 nor keep it.
Links to Other Services
The Virtual Site may include links to third parties’ websites or locations. If it does, it is for their convenience and that does not imply endorsement of said websites, locations or contents by us. The Administrators do not control the websites, applications or other services operated by third parties and thus take no responsibility regarding their privacy and data protection practices. We recommend, therefore, that you become familiar with their respective norms and privacy practices once you access a third party’s website, application and/or service.

2.- The use of this Virtual Site is governed by and subject to the acceptance, by its users, of these Terms and Conditions, as well as any subsequent modification in these particulars, made by The Administrators and published on the Virtual Site.
3.- The information presented on the Virtual Site is to be used only for informative purposes. The users of the Virtual Site may copy, reproduce, distribute, publish and download the information, documents and materials contained in the Virtual Site (collectively referred to as “The Materials”), as long as (i) the use of The Materials implies no commercial use and/ or profit; (ii) The Administrators are acknowledged as copyrights holders and, if applicable, (iii) third parties are also acknowledged whenever The Materials include content property of – and for which any responsibility and/or liability relies on – said third parties and not The Administrators. The users may not set “frames” around The Materials without first receiving express written authorization from The Administrators.
4.- The Administrators reserve the right to alter, limit or discontinue at their sole discretion the Virtual Site, including The Materials within it. The Administrators (i) will be under no obligation to take any user’s needs into account in regards to the Virtual Site or The Materials and (ii) reserve the right to deny, at their sole discretion, access to the entire Virtual Site or any of its sections to any user without prior notification.
5.- This Virtual Site also contains links to third parties’ virtual sites, as well as information not under control of The Administrators. Thus, The Administrators will be responsible, neither for the content nor for the links that may appear on said sites. The presence of a link on this Virtual Site does not mean The Administrators approve or endorse its content.
6.- The Materials are published on the Virtual Site without any express or implied warranty whatsoever, including but not limited to, warranty of merchantability, suitability, compliance with rules and regulations or fitness for a particular purpose. The users of the Virtual Site assume all the risk for its use. The Administrators do not guarantee by any means the accuracy, plenitude or opportunity of The Materials published on the Virtual Site, and under no circumstance, including but not limited to negligence, will they be liable for any expense or damage – be it direct, indirect, incidental, special or consequential – incurred as a result of their use; including expenses or damages result of inaccuracies, mistakes, omissions, interruptions, defects, computers malfunctions, computer virus, communication channels malfunction, modification or use of any of the Virtual Site’s contents, or any other resulting from and/or linked to the use of the Virtual Site, regardless of the cause of the resulting damages. The Materials may use resources, inputs, works and data from other sources, including public ones. As such, The Administrators do not guarantee The Materials to be free from mistakes, omissions and/or inaccuracies.
7.- The information referring to a specific date pertains exclusively to said date, and The Administrators are under no obligation to update The Materials, whether in their entirety or in part. The Administrators, nonetheless, have the authority to expand, modify, improve or update The Materials at their discretion, periodically and without prior notification, and reserve the right to limit or stop publishing the Virtual Site as well as deny, without prior notice, access to it to any user. Besides, maps and any other information of similar characteristics found on this Virtual Site, are to be considered only for reference purposes and thus may not have been produced or be suitable for engineering, topography or any other specific use and/or purpose. Borders, colors, denominations or any other information displayed either on a map or otherwise, may not be interpreted as an opinion of the legal status of any territory, and neither as acceptance of said borders.
8.- The users of this Virtual Site accept using it at their entire and sole responsibility. Thus, as a condition for the use of this Virtual Site, every user of this Virtual Site binds him/herself to indemnify and hold The Administrators harmless from each and any of the actions, claims, loses, damages, harms, obligations and expenses (including reasonable legal fees) that may result of the use of this Virtual Site, including, but not limited to, any claims alleging facts that, if proven true would constitute a breach, by the user, of those conditions (the “Claims”). The obligation to indemnify The Administrators includes, but is not limited to, claims made based on any failure, mistake, omission, interruption or delay related to the use of this Virtual Site. Under no circumstance, even due to negligence, will The Administrators be liable for any direct, indirect, incidental or special damage; not even when The Administrators may have been alerted of the potential occurrence of said damages. If the user of this Virtual Site is not satisfied with any of The Materials of this Virtual Site or the conditions laid out for its use, his/her only resource is to stop using this Virtual Site.
9.- No Material may be interpreted, expressly or implicitly, as a recommendation for investments and neither does it or will it constitute an offer or invitation made by or on behalf of The Administrators to acquire or sell securities and it may neither be considered as investment advice.
10.- The Administrators by no means aim to or do solicit any action in regards to financial instruments of their property, through the Virtual Site.
11.- This Virtual Site may contain recommendations, opinions and statements from diverse information and content providers. The Administrators do not declare or ratify the accuracy or reliability of any recommendation, opinion, declaration or other information delivered either by a content or information provider or by any user of this Virtual Site or other person or entity.
12.- Unless otherwise specified, The Materials published on the Virtual Site are property of The Administrators and are subject to copyright, trade mark and other intellectual property laws in the United States of America and other jurisdictions. All use of the Virtual Site is subject to these laws.
13.- The user of this Virtual Site expressly recognizes and agrees that The Administrators are not be held liable for the conduct of this Virtual Site’s users. Should this Virtual Site contain electric banners, conversational spaces (forums or “chat rooms”), access to distribution lists and/or other means that make possible the sending of messages or other types of communication (jointly referred to as “Forums”), the user of this Virtual Site agrees to use said Forums only to send and receive messages and materials appropriated and related to the Forum at issue. In using any of the Forums the user of this Virtual Site agrees to abstain from, without limitation, the following conducts:
a. Defame, abuse, harass, stalk, threaten or in any other way violate the legal rights of third parties (such as privacy and publicity rights) including, but not limited to, The Administrators.
b. Publish, advertise, distribute or disseminate slanderous, obscene, indecent or illicit information.
c. Upload or attach files containing software or other materials protected by intellectual property rights (or by laws of privacy and publicity), unless the user owns or has the rights to said software or materials under his/her control, or when he/she has obtained appropriate authorization.
d. Upload or attach files containing virus, corrupt files or other software that might affect third parties’ computers and their functioning.
e. Delete or eliminate any authorship attribution, legal disclaimers or property designations, or any other signs or rubrics from any given uploaded file.
f. Forge the origin or source of computer software.
g. Advertise or offer goods or services, perform or send surveys, contests or chain letters.
h. Download files which the downloading user knows, or should reasonably know, are not to be downloaded and thus cannot be distributed legally once downloaded.
The user of this Virtual Site acknowledges that all Forums or discussion groups constitute public communications, not private ones. Besides, the user recognizes that chats, ads, conferences, electronic messages and other communications pertaining other users are not backed up by The Administrators and thus are not considered, reviewed, evaluated or approved by The Administrators. The Administrators reserve the right to eliminate, for any reason and without prior notice, any content from the Forums created by the users of this Virtual Site, including, without limitation, any electronic message or advertisment on an electronic banner, among other contents.
14.- The Administrators make no affirmation regarding The Materials being or not appropriate or regarding their availability outside of the United States of America and its territories. Access to The Materials is prohibited in any place where such content may be illegal. Whoever gains access to the Virtual Site from outside The United States of America and its territories, assumes sole liability in compliance to local legislation. These Terms and Conditions are to be governed, interpreted and applied in accordance with the legislation of The District of Columbia, United States of America, except for the conflict-of-laws provisions of said jurisdiction. Any legal action regarding the contents of the Virtual Site is to be settled by arbitration in accordance to the rules of the American Arbitration Association. The final determination will rest on a sole arbiter. The place for arbitration shall be Washington, District of Columbia, United States of America, and the language to be used throughout the arbitration process shall be English. No waiver by The Administrators of any provision of these Terms and Conditions shall be valid, unless stipulated otherwise in writing and signed by a duly authorized representative.
15.- Nothing herein, as well as no content on the Virtual Site, shall be considered a limitation or waiver of any of the privileges and immunities enjoyed by The Administrators; privileges and immunities which remain instead specifically reserved.
